Mark Barthel and Dianne Barthel, husband and wife (hereafter “Defendants Barthel,” or “Barthels”) for their answer to the Plaintiff’s Complaint state as Follows:

1. Admit and agree with the allegations of the Plaintiff’s complaint.

COUNTER CLAIM AND CROSS CLAIM

Defendants Mark Barthel and Dianne Barthel for their Counter Claim and Cross Claim seek to change the legal description of their property located at 7153 Rosewood Avenue NW, South Haven, 55382 consistent with the legal description of the Plaintiffs and to further to identify and to establish a non-exclusive access easement over Rosewood Avenue NW as presently located. Therefore Defendants Barthel state and allege:

PARTIES

1. Mark Barthel and Dianne Barthel are husband and wife and are natural persons whose address is 300 Idaho Ave, Big Lake, MN 55309.

2. That Plaintiffs Troy Loken and Deanna Loken are natural persons whose address is 3934 Welcome Ave N, Minneapolis, MN 55422.

3. Gordon F. Hopkins is a natural person whose address is 7137 Rosewood Avenue NW, South Haven, MN 55382.

4. Mortgage Electronic Registration Systems, Inc. (“MERS”), a Delaware corporation whose address is 1818 Library Street, Suite 300, Reston, VA 20190, holds a Mortgage recorded October 29, 2019 with the Wright County Recorder as Document No. A1409393 given by Gordon Hopkins to Mortgage Electronic Registration Systems, Inc. as nominee for Bremer Bank, National Association.

5. Roger A. Salmela and Susan J. Salmela are natural persons whose address is 7116 Rosewood Avenue NW, South Haven, MN 55382.

6. CU Mortgage Services, Inc., a Minnesota corporation whose address is 500 Main Street, Suite 100, New Brighton, MN 55112, holds a Mortgage recorded October 22, 2012 with the Wright County Recorder as Document No. A1216793 given by Roger A. Salmela and Susan J. Salmela to Building Trades Federal Credit Union, which Mortgage was assigned by Assignment of Mortgage to CU Mortgage Services, Inc. recorded October 22, 2012 with the Wright County Recorder as Document No. A1216794.

7. Building Trades Federal Credit Union, a federal credit union whose address is 12080 73rd Avenue N., Maple Grove, 55369, holds a Mortgage recorded May 27, 2015 with the Wright County Recorder as Document No. A1288539 given by Susan J. Salmela and Roger A. Salmela to Building Trades Federal Credit Union.

7. Mark R. Nystedt is a natural person whose address is 7105 Rosewood Ave NW, South Haven, MN 55382.

8. Dustin D. Pierce and Joleen H. Pierce are natural persons whose address is 7099 Rosewood Avenue NW, South Haven, MN 55382.

9. Liberty Savings Bank, a federal savings bank whose address is 111 7th Avenue S., St. Cloud, MN 56301, holds a Corrective Mortgage recorded May 2, 2014 with the Wright County Recorder as Document No. A1262392, which was recorded to replace that certain Mortgage recorded April 23, 2014 as Document No. 1261836 given by Joleen H. Pierce and Dustin D. Pierce to Liberty Savings Bank.

10. Liberty Bank Minnesota, a Minnesota Chartered Bank whose address is 2842 2nd Street South, St. Cloud, MN 56301, holds a Mortgage recorded August 17, 2020 with the Wright County Recorder as Document No. A1436991 given by Dustin D. Pierce and Joleen H. Pierce to Liberty Bank Minnesota.

11. Sharon L. Cameron is a natural person whose address is 7079 Rosewood Avenue NW, South Haven, MN 55382.

12. Mortgage Electronic Registration Systems, Inc., a Delaware corporation whose address is 1818 Library Street, Suite 300, Reston, VA 20190, holds a Mortgage recorded August 24, 2018 with the Wright County Recorder as Document No. A1378103 given by Sharon L. Cameron to Mortgage Electronic Registration Systems, Inc. as nominee for PennyMac Loan Services, LLC.

13. Samuel E. Millner and Alicia E. Millner are natural persons whose address is 6947 Redwood Avenue NW, South Haven, MN 55382.

14. Mortgage Electronic Registration Systems, Inc., a Delaware corporation whose address is 1818 Library Street, Suite 300, Reston, VA 20190, holds a Mortgage recorded August 31, 2016 with the Wright County Recorder as Document No. A1323374 given by Samuel E. Millner aka Samuel Edward Millner and Alicia E. Millner aka Alicia Elizabeth Millner to Mortgage Electronic Registration Systems, Inc. as nominee for Annandale State Bank.

15. Lake Central Bank f/k/a Annandale State Bank, a business corporation whose address is 40 Chestnut Street W., Annandale, MN 55302, holds a Mortgage recorded September 17, 2015 with the Wright County Recorder as Document No. A1297712 given by Samuel E. Millner and Alicia E. Miller to Annandale State Bank, amended by Amendment to Mortgage recorded August 25, 2020 with the Wright County Recorder as Document No. A1438033.

16. Peter M. Jonas and Tina J. Jonas are natural persons whose address is 9920 Jordan Avenue NE, Hanover, MN 55341.

17. Liberty Bank Minnesota, a Minnesota corporation whose address is 111 7th Avenue South, St. Cloud, MN 56301, holds a Mortgage recorded April 22, 2016 with the Wright County Recorder as Document No. A1312809 given by Peter M. Jonas and Tina J. Jonas to Liberty Bank Minnesota.

18. Randy J. Brandel and Roberta D. Brandel are natural persons whose address is 15020 70th Street SW, #325, Cokato, MN 55321.

JURISDICTION

19. The real property that is the subject of this action is located in Wright County, Minnesota.

FACTS

20. On October 23, 2012, Defendants Barthel acquired title to real property located in Wright County, Minnesota commonly known as 7153 Rosewood Avenue NW, South Haven, MN 55382 (the “Property”). The Property acquired by Defendants Barthel is the subject of this Counter Claim and Cross Claim.

21. The Property depends on its access on Rosewood Avenue NW, which is a private road. In the historical chain of title, Rosewood Avenue NW is described as a cartway. However, Rosewood Avenue NW is not a publicly dedicated and maintained right of way. It is maintained and plowed by the property owners, who use it for access to their land. There is no private easement for Rosewood Avenue NW recorded in the land records.

22. The deeds by which Barthels acquired the Property were recorded in the office of the Wright County Recorder on March 29, 2019 as Document No. A1392676 and on May 15, 2012 as Document No. A1202745 (the “Vesting Deeds”). A copy of the Vesting Deeds are attached hereto as Exhibit 1 and Exhibit 2, respectively.

23. The legal description of the Property as set forth on the Vesting Deed is vague in that it uses a distance call along the shoreline of Union Lake and is not consistent with the legal of the Plaintiffs and the claim for a defined easement.

24. Barthels had a licensed surveyor at Westwood Professional Services, Inc. (“Westwood”) determine a correct legal description of the Property, which legal description is consistent with the properties located to the East (owned by Plaintiffs Troy Loken and Deanna Loken) and the West (owned by Defendants Randy J. Brandel and Roberta D. Brandel). A copy of the survey of the Property is attached hereto as Exhibit 3. The new legal description of the Property as composed by Westwood is attached hereto as Exhibit 4.

25. A copy of the survey prepared by Westwood showing the Property and the Easement Description is attached hereto as Exhibit 3.

26. Westwood has also composed a legal description for an easement over Rosewood Avenue NW (the “Easement Description”). The Easement Description has been prepared by Westwood in a way that matches the roadbed of Rosewood Avenue NW and does not conflict with the legal descriptions of the other property using Rosewood Avenue NW for access. The Easement Description is shown on the survey (Exhibit 3 and Exhibit 4). The Easement Description is attached hereto as Exhibit 4.

27. The legal description of the Property, together with its access easement over Rosewood Avenue NW is set forth on the attached Exhibit 4. The purpose of this action is to quiet title to the legal description on Exhibit 4 in the names of the Defendants Mark Barthel and Dianne Barthel.

28. The legal description set forth on Exhibit 4 follows the lines of occupation for the Property, conforms to the adjoining property descriptions, and eliminates the ambiguities inherent in the historical legal descriptions.

29. Defendants Mark Barthel and Dianne Barthel and Defendants Mark Barthel and Dianne Barthel’s predecessors in title have occupied and possessed the Property described in Exhibit 3 for 30 years or more, as evidenced by the Warranty Deed recorded on February 5, 1992 Document No. 500680, attached as Exhibits 5, and Document No. 327574, attached as Exhibit 6.

30. Defendants Barthel and Defendants Barthel’s predecessors in title have used Rosewood Avenue NW for ingress and egress to the Property for 30 years or more, as evidenced by the source deeds Document No. A1392676 and A1202745 attached hereto as Exhibits 1 and 2.

COUNT I

ACTION TO DETERMINE ADVERSE CLAIMS:

ADVERSE POSSESSION

31. Defendants Barthel reallege and incorporate by reference each of the previous paragraphs of their Counter and Cross Claim.

32. Minnesota Stat. § 559.01 et seq. provides for an action to determine that a party who adversely possesses real estate against another is the legal owner of that property. Minnesota Stat. § 541.02 requires that a plaintiff claiming title by adverse possession or the plaintiff’s ancestor, predecessor, or grantor must be “seized or possessed of the premises in question within 15 years before the beginning of the action.” If the parcel claimed adversely is separately taxed, in order to prevail, “the party claiming title by adverse possession or the party’s ancestor, predecessor, or grantor or all of them together, shall have paid taxes on the real estate in question at least five consecutive years of the time during which the party claims these lands to have been occupied adversely.” Minn. Stat. § 541.02. However, “the provisions of the preceding paragraph [regarding payment of real estate taxes], shall not apply to actions relating to the boundary line of lands, which boundary lines are established by adverse possession . . .” Minn. Stat. § 541.02.

33. Plaintiffs and Plaintiffs’ predecessors in title have been seized of the Property for more than 30 years. Plaintiffs and Plaintiffs’ predecessors in title have occupied the Property to the exclusion of Defendants for 30 years or more.

34. Defendants Barthel and Defendant Barthel’s predecessors in title have possessed the Property actually, openly, exclusively, adversely and continuously for a period in excess of 15 years.

COUNT II

ACTION TO DETERMINE ADVERSE CLAIMS:

PRESCRIPTIVE EASEMENT

35. Defendants Barthel reallege and incorporate by reference each of the previous paragraphs of their Counter and Cross Claim.

36. Minnesota Stat. § 559.01 et seq. provides for an action to determine that a party who adversely possesses real estate against another is the legal owner of that property. The right to use the property of another as an easement for a specific purpose may be established with the same evidence as required to establish adverse possession under Minnesota Stat. § 541.02, with one key distinction: possession of the land is not required. Easements are by nature incorporeal rights. They do not exclude possession by other parties. So, the claimant of a prescriptive easement is only required to establish an adverse use of the subject property for a specific purpose. See Ebenhoh v. Hodgman, 642 N.W.2d 104, 112 (Minn. Ct. App. 2002); Mehrkens v. Ryan, 2003 WL 21694568 (Minn. Ct. App. 2003); Heuer v. County of Aitkin, 645 N.W.2d 753 (Minn. Ct. App. 2002); Rogers v. Moore, 603 N.W.2d 650, 657 (Minn. 1999); Magnuson v. Cossette, 707 N.W.2d 738, 745 (Minn. Ct. App. 2006); Wasiluk v. City of Shoreview, 2005 WL 1743746, 2 (Minn. Ct. App. 2005); and Claussen v. City of Lauderdale, 681 N.W.2d 722, 727 (Minn. Ct. App. 2004).

37. Plaintiff and Plaintiffs’ predecessors in title have used Rosewood Avenue NW for access purposes for more than 30 years. Plaintiffs and Plaintiffs’ predecessors in title have shared the use of Rosewood Avenue NW with Defendants for 46 years or more.

39. Rosewood Avenue NW is not taxed separately. It overlaps and abuts the Property owned by Plaintiffs and the parcels owned and encumbered by the Defendants.

40. Defendants Barthel and Defendants Barthel’s predecessors in title have used Rosewood Avenue NW as a shared access easement, actually, openly, adversely and continuously for a period in excess of 15 years.

PRAYER FOR RELIEF

WHEREFORE, Defendants Barthel pray the Court grant the following relief:

1. Determining that the Defendants Mark Barthel and Dianne Barthel are the true and rightful owners of the property described in Exhibit 3 and Exhibit 4 and that none of the Defendants or Plaintiff herein have any right, title or interest in said property.

2. Determining that the Defendants Mark Barthel and Dianne Barthel, have a prescriptive easement for access to and from the Property over the property described in Exhibit 3 and Exhibit 4, and determining that the access easement over the property described is non-exclusive in that it can be used for access to and from the other properties described above.

3. Determining that the access easement over the property described in Exhibit 3 and Exhibit 4 is permanent and appurtenant to the Property described in Exhibit 1.

4. Granting such other and additional relief as the Court deems just and equitable.

AN ORDINANCE AMENDING THE HANOVER ZONING ORDINANCE RELATED TO PARKING

The City Council of the City of Hanover hereby ordains that on the 4th day of January 2022, the City Council adopted the above Ordinance.  Due to the lengthy content of the Ordinance, a brief Summary follows:

Section 1. Rescind and replace section. Section 10-39 of the Hanover Zoning Ordinance is hereby rescinded and a new Section 10-39 is added.

Section 2. Provides for the effective date.

Section 4. Codification.

“AN ORDINANCE AMENDING THE HANOVER ZONING ORDINANCE RELATED TO PARKING” shall take effect and be in full force immediately following its adoption and upon publication of this summary. A copy of the Ordinance can be viewed by contacting the City Administrator at (763) 497-3777.

The Registrar accepted the application and appointed Judy Lund, whose address is 440 3rd Street SW, Cokato, Minnesota 55321-9410 to serve as the Personal Representative of the Decedent’s estate.

Any heir or other interested person may be entitled to appointment as personal representative or may object to the appointment of the personal representatives. Any objection to the appointment of the personal representatives must be filed with the Court, and any properly filed objection will be heard by the Court after notice is provided to interested persons of the date of hearing on the objection.

Unless objections are filed, and unless the Court orders otherwise, the personal representatives have full power to administer the estate, including, after thirty (30) days from the issuance of letters of general administration, the power to sell, encumber, lease, or distribute any interest in real estate owned by the decedent.

Notice is further given that, subject to Minn. Stat. § 524.3-801, all creditors having claims against the decedent’s estate are required to present their claims to the personal representative or to the Court within four (4) months after the date of this notice or the claims will be barred.
