SUMMARY PUBLICATION ORDINANCE NO. 2023-5

Chapter 45, Adding Tetrahydrocannabinol (Cannabinoid) Products

On March 20, 2023, the Buffalo City Council adopted an ordinance designated as Ordinance No. 2023-5, the title of which is stated above. The purpose of this ordinance is to regulate the possession and sale of any product that contains tetrahydrocannabinol and that meets the requirements to be sold for human or animal consumption under Minn. Stat. § 151.72.

BE IT FURTHER RESOLVED, that the City Clerk is directed to keep a copy of the Ordinance at City Hall for public inspection and to post a full copy of the Ordinance in a public place in the City for a period of two weeks.  Copies of the Ordinance are also available on the City’s website and upon request by calling 763-682-1181.

 That City Code Section 48-106(c) Connection required; private system prohibited; exception will be amended by the addition of the following:

“Where a pump, grinder station, or other similar mechanical device is needed to carry the sewer flows from the building or premise to the public sanitary sewer main, all such devices including electrical service, controls, and associated components for the operation of the device and piping from the main to the building or premise shall be considered part of the private sewer service and shall be owned and maintained by the property owner.”

This Ordinance shall become effective upon adoption and publication.

AN ORDINANCE RESCINDING ORDINANCE NO. 2022-4 AND LIFTING THE

MORATORIUM ON THE SALE AND MANUFACTURE OF HEMP DERIVED THC (TETRAHYDROCANNABINOLS) FOOD AND BEVERAGES IN THE CITY OF BUFFALO

WHEREAS, on August 1, 2022, the City Council adopted Ordinance No. 2022-4 establishing a moratorium on the sale and manufacture of THC products

WHEREAS, the purpose of the moratorium was to conduct a study to consider licensing rules and regulations and sales management for the sale and manufacturing of food and beverage products that contain THC, whether for medical, recreational or for other human consumption purposes.

WHEREAS, the City Council has reviewed recommendations of staff and city attorney and has now adopted said controls for the sale of THC food and beverages which makes the moratorium no longer necessary.

NOW, THEREFORE, the City Council of the City of Buffalo ordains:

SECTION 1: Ordinance No. 2022-4 is hereby rescinded. 

SECTION 2: Effective Date: The rescission of Ordinance No. 2022-4 shall be effective upon the passage and publication of this ordinance.

Assessment Notice

NOTICE IS HEREBY GIVEN, That the Local Board of Appeal and Equalization of the TOWNSHIP OF BUFFALO of Wright County, Minnesota, will meet at the Office of the Clerk in said Township, at 9:00:00 a.m., on Thursday, the 13th day of April, 2023. The purpose of this meeting is to determine whether property in the jurisdiction has been properly valued and classified by the assessor.

If you believe the value or classification of your property is incorrect, please contact your assessor’s office to discuss your concerns. If you disagree with the valuation or classification after discussing it with your assessor, you may appear before the local board of appeal and equalization. The board will review your assessments and may make corrections as needed. Generally, you must appeal to the local board before appealing to the county board of appeal and equalization.

SUMMONS

Daniel G. Eisenschenk and Cindy C. Eisenschenk, husband and wife, Plaintiffs,

vs.

Michael J. Sicheneder and Jason Sicheneder; 17833 LLC, a Minnesota limited liability company; Bruce M. Leimer and Darlene K. Leimer, as Trustees of the Trust Agreement of Bruce and Darlene Leimer; and any all other persons or parties unknown claiming any right, title, estate, lien or interest in the real estate described in the Complaint herein, Defendants.

THE STATE OF MINNESOTA TO THE ABOVE-NAMED DEFENDANT(S):

1. You are being sued. The plaintiffs have started a lawsuit against you.  The plaintiffs’ complaint against you is attached to this summons.  Do not throw these papers away.  They are official papers that affect your rights.  You must respond to this lawsuit even though it may not yet be filed with the court and there may be no court file number on this summons.

2. YOU MUST REPLY WITHIN 20 DAYS TO PROTECT YOUR RIGHTS. You must give or mail to the person who signed this summons a written response called an answer within twenty (20) days of the date on which you received this summons.  You must send a copy of your answer to the person who signed this summons, whose address appears at the end of this document.

3. YOU MUST RESPOND TO EACH CLAIM. The answer is your written response to the plaintiffs’ complaint.  In your answer you must state whether you agree or disagree with each paragraph of the complaint.  If you believe the plaintiffs should not be given everything asked for in the complaint, you must say so in your answer.

4. YOU WILL LOSE YOUR CASE IF YOU DO NOT SEND A WRITTEN RESPONSE TO THE COMPLAINT TO THE PERSON WHO SIGNED THIS SUMMONS. If you do not answer within twenty (20) days, you will lose this case.  You will not get to tell your side of the story and the court may decide against you and award the plaintiff everything asked for in the complaint.  If you do not want to contest the claims stated in the complaint, you do not need to respond.  A default judgment can then be entered against you for the relief requested in the complaint.

5. LEGAL ASSISTANCE.  You may wish to get legal help from a lawyer.  If you do not have a lawyer, the court administrator may have information about places where you can get legal assistance. Even if you cannot get legal help, you must still provide a written answer to protect your rights or you may lose the case.

6. ALTERNATIVE DISPUTE RESOLUTION. The parties may agree to or be ordered to participate in an alternative dispute resolution process under Rule 114 of the Minnesota General Rules of Practice.  You must still send your written response to the complaint even if you expect to use alternative means of resolving this dispute.

7. THIS LAWSUIT MAY AFFECT OR BRING INTO QUESTION TITLE TO REAL PROPERTY LOCATED IN WRIGHT COUNTY, STATE OF MINNESOTA, LEGALLY DESCRIBED AS FOLLOWS: The North 198.00 feet of the East 204.53 feet of the Northeast Quarter of the Northwest Quarter of Section 30, Township 120, Range 28, Wright County, Minnesota.

AND

That part of the West Half of the Northeast Quarter of Section 30, Township 120, Range 28, Wright County, Minnesota, described as follows:

Beginning at the Northwest corner of said West Half of the Northeast Quarter; thence on an assumed bearing of South 87 degrees 39 minutes 28 seconds East, along the North line of said West Half of the Northeast Quarter, a distance of 99.00 feet; thence South 01 degrees 02 minutes 10 seconds East, parallel with the West line of said West Half of the Northeast Quarter, a distance of 198.0 feet; thence North 87 degrees 39 minutes 28 seconds West, parallel with the North line of said West Half of the Northeast Quarter, a distance of 99.00 feet to the West line of said West Half of the Northeast Quarter; thence North 01 degrees 02 minutes 10 seconds West, along last said line, a distance of 198.00 feet to the point of beginning and there terminating.
