Lien Foreclosure Sale

WHEREAS, default has been made in the terms and conditions of the Declaration of Bailey Gardens, C.I.C. No. 56 (henceforth the Declaration) dated July 12, 2002 and recorded in the office of the County Recorder in and for Wright County, Minnesota on July 12, 2002 as Document No. 798620, which Lien covers the following described property situated in the County of Wright and State of Minnesota, to-wit:

Lot 1, Block 3, The Fields of St. Michael Third Addition, C.I.C. No. 56, according to the plat thereof on file or of record in the Office of the County Recorder, in and for Wright County, Minnesota.

WHEREAS, pursuant to said Declaration, there is claimed to be due and owing as of the date of this Notice by Timothy J. Froemming and Kimberly J. Froemming, as unit owners to Bailey Gardens Homeowners Association, the principal amount of One Thousand Eight Hundred Ninety Dollars and No/100 ($1,890.00) for assessments through April, 2020; and no action being now pending at law or otherwise to recover said debt or any part thereof, and;

WHEREAS, pursuant to said Declaration, and the statute in such case made and provided, said debt creates a lien upon said premises in favor of Bailey Gardens Homeowners Association.

NOW, THEREFORE, notice is hereby given that by virtue of the power of sale created by statute, said lien will be foreclosed by the sale of said premises with the hereditaments and appurtenances, which said sale will be made by the Sheriff of Wright County, Minnesota at the Sheriff’s main office, 3800 Braddock Avenue NE, Buffalo, MN, in said County on July 2, 2020 at 10:00 a.m., at public auction to the highest bidder, for cash, to pay the amount then due for said assessments, together with the costs of foreclosure, including attorney’s fees as allowed by law.  The time allowed by law for redemption by the unit owners, their personal representatives or assigns, is six (6) months from the date of said sale.

TIME AND DATE TO VACATE PROPERTY: If the real estate is an owner-occupied single family dwelling, unless otherwise provided by law, the date on or before which the unit owners must vacate the property if the lien is not reinstated under section 580.30 or the property is not redeemed under section 580.23 is 11:59 p.m. on January 2, 2021. If the foregoing date is a Saturday, Sunday or legal holiday, then the date to vacate the property is the next business day at 11:59 p.m.

Steven J. Cheney, Plaintiff,

Helen C. Nelson or her Successors as Trustees of the Helen C. Nelson Revocable Trust dated August 23, 2018, State of Minnesota and all other persons unknown claiming any right, title, estate, interest, or lien in the real estate described in the Complaint herein Defendants.

THIS SUMMONS IS DIRECTED TO DEFENDANTS ABOVE-NAMED.

1. YOU ARE BEING SUED. The Plaintiff has started a lawsuit against you. The Plaintiff’s Complaint against you is on file in the office of the Court Administrator of the above-named Court. Do not throw these papers away. They are official papers that affect your rights. You must respond to this lawsuit even though it may not yet be filed with the Court and there may be no court file number on this Summons.

2. YOU MUST REPLY WITHIN 20 DAYS TO PROTECT YOUR RIGHTS. You must give or mail to the person who signed this summons a written response called an Answer within 20 days of the date on which you received this Summons. 3. YOU MUST RESPOND TO EACH CLAIM. The Answer is your written response to the Plaintiff’s Complaint. In your Answer you must state whether you agree or disagree with each paragraph of the Complaint. If you believe the Plaintiff should not be given everything asked for in the Complaint, you must say so in your Answer.

4. YOU WILL LOSE YOUR CASE IF YOU DO NOT SEND A WRITTEN RESPONSE TO THE COMPLAINT TO THE PERSON WHO SIGNED THIS SUMMONS. If you do not answer within 20 days, you will lose this case. You will not get to tell your side of the story, and the Court may decide against you and award the Plaintiff everything asked for in the Complaint. If you do not want to contest the claims stated in the Complaint, you do not need to respond. A default judgment can then be entered against you for the relief requested in the Complaint.

5. LEGAL ASSISTANCE. You may wish to get legal help from a lawyer. If you do not have a lawyer, the Court Administrator may have information about places where you can get legal assistance. Even if you cannot get legal help, you must still provide a written Answer to protect your rights or you may lose the case.

6. ALTERNATIVE DISPUTE RESOLUTION. The parties may agree to or be ordered to participate in an alternative dispute resolution process under Rule 114 of the Minnesota General Rules of Practice. You must still send your written response to the Complaint even if you expect to use alternative means of resolving this dispute.

7. THIS LAWSUIT MAY AFFECT OR BRING INTO QUESTION TITLE TO REAL PROPERTY located in Wright County, State of Minnesota, legally described as follows:

The North 20.00 rods of the East Half of Government Lot 1 of Section 35, Township 120, Range 25, Wright County, Minnesota.

AND:

Government Lot 4, Section 26, Township 120, Range 25, Wright County, Minnesota.

Subject to the proprietary and sovereign rights of the State of Minnesota in all that portion of the land lying below the natural ordinary high watermark of Green Mountain Lake; not intending, however, to deprive the fee owners of the usual riparian rights that attach to the land riparian to a navigable public body of water incident to the ownership thereof.

The object of this action is to procure a judgment that the Plaintiff is the owner in fee simple absolute, of said real estate, and that the Defendants, and each of them, have no right, title, estate, interest, or lien herein or thereon, or in any part thereof.

Notice is given that an application for informal probate of the Decedent’s Will, dated June 4, 1991, (“Will”), has been filed with the Registrar. The application has been granted.

Notice is also given that the Registrar has informally appointed Lori Winter, whose address is 8836 Darlington Ave. NE, Monticello, MN 55362, as personal representative of the Estate of the Decedent. Any heir, devisee or other interested person may be entitled to appointment as personal representative or may object to the appointment of the personal representative. Unless objections are filed with the Court (pursuant to Minnesota Statutes section 524.3-607) and the Court otherwise orders, the personal representative has full power to administer the Estate, including, after 30 days from the date of issuance of letters, the power to sell, encumber, lease or distribute real estate.
