NOTICE IS HEREBY GIVEN, that under and by virtue of the Findings of Fact,
Conclusions of Law and Order for Judgment against Defendants PAC Homes, Inc.,
and the Minnesota Department of Revenue, dated August 25, 2008, and entered in
the above entitled action on August 29, 2008, by the District Court of Wright
County, Minnesota, Tenth Judicial District, (“Judgment”) a certified copy of
which has been delivered to me, directing the sale of the premises hereinafter
described to satisfy the amount found and adjudged due Plaintiff Lakeland
Construction Finance, LLC (“Lakeland”), as mortgagee and lender, in the above
entitled action from PAC Homes, Inc., the undersigned Sheriff of Wright County
will sell at public auction, to the highest bidder, for cash, on January 9,
2009, at 10:00 a.m., at the Wright County Sheriff's Office, 10 2nd Street,
Northwest, Room 170, Buffalo, Minnesota 55313, the premises and real estate,
lying and being in the County of Wright, State of Minnesota, described in said
Judgment, to wit (“Property”):
The North 80.0 feet of the South 140.0 feet of the following described parcel:
Commencing 18 rods North and 2 rods East from the Southwest corner of the
Southwest Quarter of the Southwest Quarter of Section 27, Township 119, Range
28; thence East 12 rods; thence North 14 rods; thence West 12 rods; thence South
14 rods to the point of beginning (the “Land”);
Together with (a) all of the buildings, structures and other improvements now
standing or at any time hereafter constructed or placed upon the Land; (b) all
heating, plumbing and lighting apparatus, elevators and motors, engines and
machinery, electrical equipment, incinerator apparatus, air-conditioning
apparatus, water and gas apparatus, pipes, water heaters, refrigerating plant
and refrigerators, water softeners, carpets, carpeting, storm windows and doors,
window screens, screen doors, storm sash, window shades or blinds, awnings,
locks, fences, trees, shrubs, and all other furniture, fixtures, machinery,
equipment, appliances and personal property of every kind and nature whatsoever
now or hereafter owned by the Mortgagor and located on, attached or affixed to
the Land and/or any improvements located thereon, including all extensions,
additions, improvements, betterments, renewals and replacements of any of the
foregoing; (c) all hereditaments, easements, rights, privileges and
appurtenances now or hereafter belonging, attached or in any way pertaining to
the Land or to any building, structure or improvement now or hereafter located
thereon; (d) the immediate and continuing right to receive and collect all
rents, income, issues and profits now due and which may hereafter become due
under or by virtue of any lease or agreement (oral or written) for the leasing,
subleasing, use or occupancy of all or part of the Land now, heretofore or
hereafter made or agreed to by the Mortgagor; (e) all of the leases and
agreements described in (d) above, together with all guarantees therefor and any
renewals or extensions thereof; and (f) all insurance and other proceeds of, and
all condemnation awards with respect to, the foregoing (all of the foregoing is
hereinafter collectively referred to as the “Property”).
The Property does not have an address assigned to the lot. The tax parcel
identification number of the Property is 105-500-273340.
The Property shall be sold to pay the debt then secured by that certain mortgage
executed by PAC Homes, Inc., as mortgagor, in favor of Lakeland, as mortgagee
and lender, dated March 24, 2005, which was recorded against the Property on
April 15, 2005, in the Office of the Wright County Recorder, as Document No. A
955044 (“Mortgage”), the principal amount secured by the Mortgage being
$110,000.00. The total amount due and owing on the Mortgage as of the date of
this notice is $162,451.69, plus interest, costs, and attorneys' fees that have
accrued since the entry of the Judgment, and will continue to accrue. The
interest rate is 8.00%.
The time allowed by law for redemption by the Mortgagor, the Mortgagor's
personal representatives, successors, or assigns is six months from the date of
said sale. Each holder of a junior lien may redeem in the order and manner
provided in Minn. Stat. §§ 580.24 and 580.25, beginning after the expiration of
the Mortgagor's redemption period.
