Notice is given that on October 28, 2014, at 9:00 a.m., a hearing will be held in this Court at 10 Northwest Second Street, Buffalo, Minnesota, for the formal probate of an instrument purporting to be the Will of the Decedent, dated February 26, 1986, (“Will”), and for the appointment of Bernice E. Bursch, whose address is 2596 10th Street Southwest, Buffalo, Minnesota 55313 as Personal Representative for the Estate of the Decedent in an UNSUPERVISED administration.

Any objections to the petition must be filed with the Court prior to or raised at the hearing. If proper and if no objections are filed or raised, the Personal Representative will be appointed with full power to administer the Estate including the power to collect all assets, to pay all legal debts, claims, taxes and expenses, to sell real and personal property, and to do all necessary acts for the Estate.

NOTICE IS HEREBY GIVEN that a Petition for Supervised Trust Administration pursuant to Minn. Stat. §501B.16 for the above-entitled Fischer Trust signed by Gregory S. Fischer dated as of July 29th, 2014 has been filed with the Court, which requests an order for the following relief:

a. Finding that Decedent, Richard E. Fischer, is dead;

b. Finding that jurisdiction and venue are proper;

c. Determining Decedent’s domicile at death;

d. Determining that the Fischer Trust, and the First Addendum and Second Addendum thereto, are valid, enforceable, unrevoked, and should be administered;

e. Determining the identity of the persons who are and who are not the beneficiaries of the Fischer Trust, and the First Addendum and Second Addendum thereto;

f. Appointing a Guardian ad litem for a minor beneficiary until she reaches age of majority;

k. Instructing the trustee, beneficiaries, and any other interested parties in any matter relating to the administration of the trust and the discharge of the trustee’s duties;

l. Approving the payment of the car loan to the third party specified in the First Addendum and the distribution, in cash or in kind, of the Trust Assets specified in the Second Addendum to the named beneficiary thereof;

m. Approving payment from the Fischer Trust of Petitioner’s reasonable attorney’s fees, costs and disbursements expended or incurred in the administration of the Fischer Trust;

n. Consolidating a probate proceeding now pending in this county, Case File No. 86-PR-14-3714, (“Fischer Estate”) and the court proceedings relating to the Fischer Trust;

o. Granting such other or further relief as deemed necessary or appropriate.

RESOLUTION ADOPTING A MORATORIUM ON ANY NEW MINERAL

EXTRACTION FACILITY IN THE TOWN OF

ROCKFORD

WHEREAS, the Town of Rockford (“Town”) is located within Wright County, Minnesota (“County”);

WHEREAS, The County has a mining ordinance, but the Town is considering enacting similar or more restrictive ordinance;

WHEREAS, the Town is required to be at least as restrictive as the County in its ordinances and regulations;

WHEREAS, the Town Board may wish to enact additional regulations above and beyond the County’s regulations;

WHEREAS, the Town Board wishes to prohibit all forms of mineral extraction during its moratorium;

NOW, THEREFORE, BE IT RESOLVED the Board of Supervisors of the Town of Rockford resolves and ordains as follows:

1. The following ordinance is adopted

TOWN  OF ROCKFORD

ORDINANCE NO.  2014-10.7

INTERIM ORDINANCE FOR PROTECTING THE TOWN OF ROCKFORD DURING LAND USE

PLANNING PROCESS

The Board of Supervisors of the Town of Rockford ordains:

1. Definitions. For purposes of this Ordinance, the following terms shall have the following definitions:

MINERAL: Sand, gravel, rock, clay, and similar higher density non-metallic natural minerals.

MINERAL EXTRACTION: The removal of sand, gravel, rock, clay and other  minerals from the ground and off the site.

MINERAL EXTRACTION FACILITY: Any area that is being used for removal, stockpiling and storage of minerals.

2. Moratorium. Effective immediately, a moratorium is hereby imposed on any new Mineral Extraction Facility or processing of any permits for the same in the Town of Rockford. For the duration of this Ordinance, there shall be no new Mineral Extraction Facilities and no processing of permits for any new Mineral Extraction Facilities in Rockford Township.

3. Violations. Any person, firm, partnership, corporation, or other entity violating any provision of this ordinance shall be guilty of a misdemeanor, and upon conviction thereof, shall be punished pursuant to applicable statutes, including but not limited to Minnesota Statutes Section 609.02, Subd. 3, or as subsequently amended.  In the event of a violation of this ordinance, the Town may institute appropriate actions or proceedings, including injunctive relief to prevent, restrain, correct or abate such violations, and to recover costs of prosecution.

4. Authority. This ordinance is adopted under the authority of Minnesota Statutes Section 462.355, Subd. 4, and Chapter 365.

5. Effective Date and Termination. This ordinance shall take effect upon its passage and publication and shall remain in effect for twelve (12) months, unless extended as authorized by law.

6. Planning Commission to Study and Report. The Planning Commission of the Town of Rockford is hereby authorized and instructed to immediately commence study of potential ordinances and ordinance language consistent with the requirements of this ordinance and to make recommendations to the Town Board within the time frame provided for by this Ordinance;

7. Summary Approved. the Board of Supervisors of the Town of Rockford hereby adopts the following summary of the Ordinance:

On this 7 day of October, 2014 the Board of Supervisors of the Town of Rockford adopted the Interim Ordinance for Protecting the Town of Rockford During Land Use Planning Process.  The Ordinance prohibits commencement of or processing applications for mining activities and shall remain in effect for a period of twelve (12) months, unless it is earlier rescinded, or is extended as authorized by law.

A printed copy of the whole Ordinance is available for inspection in person at the offices of the Town Clerk, 3039 Dague Avenue SE, Buffalo, MN 55313.

The Town Clerk can be contacted if a copy of the Ordinance is needed.

8. Publication and Recording.The Town Clerk is forthwith directed to publish, post and record the Ordinance as follows:

a. The Clerk shall publish the entire text of the Ordinance in the Wright County Journal Press in body type no smaller than Brevier or 8 point type.  The Clerk is instructed to record the Ordinance in the Town’s Ordinance book within twenty (20) days after publication of the title and summary.  Proof of said publication shall be attached to the recorded Ordinance.

b. The Clerk is instructed to file a copy of the full text of the Ordinance with Wright County and to place a copy of the full text of the Ordinance in the Rockford library for public viewing.

THIS COMMUNICATION IS FROM A DEBT COLLECTOR.  THIS IS AN ATTEMPT TO COLLECT A DEBT AND ANY INFORMATION OBTAINED WILL BE USED FOR THAT PURPOSE

NOTICE IS HEREBY GIVEN that default has been made in the terms and conditions of the Declaration of Highwoods Townhomes Homeowners’ Association, (hereinafter the “Declaration”) recorded in the office of the County Recorder of Wright County, Minnesota on June 29, 1999, as Document No. 682571 (as amended), which covers the following property:

Legal Description: Lot 8, Block 4, Highwoods 6th Addition, CIC No. 29, Wright County, Minnesota

Property Address: 12478 43rd Street NE, St. Michael, Minnesota 55376; PID: R114-182-004080

THAT pursuant to said Declaration, there is claimed to be due and owing as of September 29, 2014, from Philip Rogers, title holder, to Highwoods Townhomes Homeowners’ Association, a Minnesota non-profit corporation, the amount of $10,553.11, for assessments, late fees and collection costs, plus additional assessments and other amounts that may have accrued since the date of this notice, including the costs of collection and foreclosure;

THAT prior to the commencement of this foreclosure proceeding, Lienor complied with all notice requirements as required by status; that no action or proceeding has been instituted at law or otherwise to recover the debt secured by said lien, or any part thereof;

 THAT the owner has not been released from his financial obligation to pay said amount;

THAT pursuant to the Declaration, said debt creates a lien upon said premises in favor of Highwoods Townhomes Homeowners’ Association, as evidenced by a lien statement recorded on June 30, 2014, in the office of the Wright County Recorder as Document No. A 1266130;

THAT pursuant to the power of sale granted by the owners in taking title to the premises subject to said Declaration, said lien will be foreclosed by the sale of said property by the sheriff of said County at the Main Office of the Wright County Sheriff, Civil Division, 3800 Braddock Avenue, NE, City of Buffalo, Wright County, Minnesota, on December 2, 2014, at 10 a.m., at public auction to the highest bidder, for cash, to pay the amount then due for said assessments, together with the costs of foreclosure, including attorney’s fees as allowed by law.  The time allowed by law for redemption by the unit owners, their personal representatives or assigns is six (6) months from the date of said sale.

DATE TO VACATE PROPERTY: The date on or before which the owner must vacate the property if the account is not brought current or the property redeemed under Minn. Stat. § 580.23 is June 2, 2015.  If the foregoing date is a Saturday, Sunday or legal holiday, then the date to vacate is the next business day at 11:59 p.m.
